The user acknowledges that AtoZ Service is merely an online technology aggregator and does not inspect, manage, or control the execution of services by independent Service Partners. To the maximum extent permitted by the Indian Consumer Protection Act and other applicable laws, AtoZ Service shall not be liable for any direct, indirect, incidental, or consequential damages, including but not limited to property damage, bodily injury, theft, or misconduct caused by the Service Partner. The user agrees that the services are booked at their sole risk and they are advised to secure independent insurance coverage for valuable appliances. In any event, the total aggregate liability of AtoZ Service for all proven claims, disputes, or negligence shall be strictly limited to the actual service fee collected by the company for that specific booking (excluding spare parts cost), and the company shall not be liable for any amount exceeding the revenue earned by it from the transaction.
The user agrees to indemnify, defend, and hold harmless AtoZ Service, its founders, directors, employees, and cloud infrastructure partners from and against any claims, liabilities, losses, damages, or legal expenses (including reasonable attorney fees) arising out of: (i) user's breach of these terms; (ii) any illegal activity, fraud, or misrepresentation by the user; or (iii) any third-party claims or property disputes resulting from the technician's visit to the user's premises.
In the event of any dispute, controversy, or claim arising out of or relating to this agreement, the platform, or the services, the parties shall first attempt to resolve it amicably through mutual discussions. If the dispute is not resolved within thirty (30) days, it shall be referred to and finally resolved by a Sole Arbitrator appointed exclusively by AtoZ Service. The arbitration proceedings shall be conducted in accordance with the Indian Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Hanamkonda / Warangal, Telangana, and the language of the proceedings shall be English.
Subject to the Mandatory Arbitration clause above, these Terms of Use shall be governed by and construed in accordance with the laws of India. The user explicitly agrees that any remaining legal matters, appeals, or judicial interventions that cannot be settled via arbitration shall be subject to the exclusive jurisdiction of the competent civil courts located in Hanamkonda / Warangal, Telangana only, to the exclusion of all other courts across India.
